Specialty Inspectors, LLC (“Company,” “we,” “our,” or “us”) respects the privacy of our clients and is committed to protecting the client information collected through our MySI mobile application (the “Application”). This Privacy Policy (the “Privacy Policy”) explains how we collect, use, disclose, and safeguard information when you use the Application. By downloading, accessing, or using the Application, you (“you” or the “user”) agree to this Privacy Policy.

Specialty Inspectors, LLC is an industry leader with decades of experience in energy efficiency certification, engineering services, and building code inspection. The Application is designed to support the Company’s inspection, certification, engineering, and related professional services by facilitating data collection, reporting, and communication with clients, contractors, and authorized partners.

1. Information Collection by Applications

We may collect certain information automatically when you download and use the Application. This information may include

  • Information you provide: phone number (used for login/verification and notifications), and any profile details you choose to provide;
  • Automatically collected information: device information (model/OS), Application usage and diagnostic data;
  • Inspection-related data (if applicable): inspection statuses, scheduling information, and notes tied to your account;
  • Your device's Internet Protocol (IP) address;
  • Device type and operating system;
  • The pages or features of the Application that you access;
  • The time and date of your visits and the time spent using the Application; and
  • Application diagnostic and performance information (i.e. crash logs).

In some cases, we may also collect personal information that you voluntarily provide when using the Application. This may include, but is not limited to, the following information:

  • First and last name;
  • Phone number;
  • Additional contact information; and
  • Information submitted in connection with inspections, certifications, or related services.

2. Location Information

With user permission, the Application may collect location information from your device to enable certain functionality and support the Company’s inspection and certification services. Location data may be derived from GPS, Wi‑Fi, cellular networks, or Bluetooth. You may disable location permissions at any time through your device settings; however, certain features may become unavailable. Location information may include approximate or precise location data depending on your device settings and may be used to

  • Verify inspection or project locations;
  • Facilitate service delivery and reporting;
  • Improve operational efficiency; and
  • Analyze usage trends and improve the functionality of the Application

If permitted by the user, the Company utilizes geolocation data to provide features such as personalized content, relevant recommendations, and location-based services. We do not collect location data when permissions are disabled.

3. Analytics and Tracking

The Application may use analytics tools, including Google Analytics for Firebase, to collect information about how users interact with the Application. These tools may collect information such as device identifiers, usage data, crash reports, and performance metrics.

This information helps the Company understand how the Application is used, diagnose technical issues, improve performance, and enhance the overall user experience.   • Provide, operate, and maintain the Application;
  • Support inspection, certification, engineering, and related professional services;
  • Document and maintain records relating to inspections, certifications, and energy programs;
  • Communicate with clients, contractors, and authorized partners;
  • Analyze usage trends and improve the functionality and performance of the Application;
  • Send service‑related notices, updates, or operational communications; and
  • Comply with legal obligations, resolve disputes, and enforce agreements.

5. Third-Party Services

The Application may use third-party services that assist the Company in analyzing Application performance and improving services. These third parties collect and process information under their own independent privacy policies, which may be located outside of the Company's Application. We do not control and are not responsible for the privacy practices of these third parties, and we encourage you to review their policies directly. Third-party services used by the Application include, but are not limited to, Google Analytics for Firebase.

6. Disclosure of Information

The Company may disclose information in the following circumstances:

  • To comply with applicable laws, regulations, or legal processes (such as subpoenas or court orders);
  • To protect the rights, safety, or property of the Company, its users, or others;
  • To investigate, prevent, or address fraud, misuse, or security issues;
  • In connection with a corporate transaction (e.g., merger, acquisition, or asset sale), where permitted by law; and
  • To trusted service providers who perform services on behalf of the Company and who are contractually obligated to protect the information and use it only for authorized purposes

8. Data Retention

The Company retains personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including maintaining records associated with inspection, certification, engineering, and applicable energy programs, unless a longer retention period is required or permitted by law (e.g., tax, audit, or regulatory requirements). You may request deletion of personal information as described below.

9. Your Privacy Rights

10. Opt-Out Rights

You may stop all collection of information by the Application at any time by uninstalling the Application. You may also manage certain data collection by adjusting device permissions (e.g., location, camera, photos) and, where available, in-app settings to limit analytics or crash reporting. If necessary, you may use the standard uninstall processes available on your mobile device or through the mobile application marketplace from which you downloaded the Application. Disabling certain permissions may affect functionality.

11. Children's Privacy

The Application is not directed to children under the age of thirteen (13), and we do not knowingly or intentionally collect personal information from children under 13. If we become aware that a child under 13 has provided personal information through the Application, we will delete such information immediately. Parents or guardians who believe a child has submitted personal information may contact us to request removal.

Children's Privacy in Florida: We do not and will not direct the Application to children under the age of 13. If any features are likely to be predominantly accessed by children, we will comply with applicable Florida requirements for such features.

12. Security

The Company maintains administrative, technical, and physical safeguards designed to protect personal information and operational data from unauthorized access, disclosure, alteration, or destruction. Safeguards may include encryption in transit, access controls, least-privilege access, logging, and regular reviews.

However, while we take reasonable measures to protect information, no method of electronic transmission or storage is completely secure. Company’s liability for loss of user information is limited by Section 15 below.

Currently, our Company is not subject to the regulations defined by the Florida Digital Bill of Rights (“FDBR”); however, we nevertheless strive to honor comparable consumer privacy practices detailed in this Privacy Policy.

13. Changes to Privacy Policy

In the Company's sole discretion, this Privacy Policy may be updated from time to time. When changes are made, the effective date of the policy will be updated accordingly. If we make material changes, we will notify you by posting the updated policy in the Application or through other appropriate channels. Your continued use of the Application after updates constitutes acceptance of the revised Policy.

14. User Consent; Data Storage

By using the Application, you consent to the collection, use, and processing of information as described in this Privacy Policy. Information collected through the Application is processed in the United States and may be stored on systems operated by us or our service providers. By using the Application, you understand that your information may be transferred to, stored in, and processed in the United States.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) ANY UNAUTHORIZED ACCESS TO OR USE OF THE APPLICATION OR ANY PERSONAL INFORMATION, OR (B) ANY LOSS, THEFT, DISCLOSURE, ALTERATION, OR DESTRUCTION OF PERSONAL INFORMATION, EXCEPT TO THE EXTENT CAUSED BY THE COMPANY’S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR VIOLATION OF APPLICABLE LAW. IN NO EVENT WILL THE COMPANY’S TOTAL LIABILITY RELATING TO PERSONAL INFORMATION EXCEED ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID (IF ANY) TO USE THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. NOTHING IN THIS POLICY AFFECTS RIGHTS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
